Terms of Service

1. Acceptance of Terms

By accessing or using Ekkora ("the Service," "we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you are using the Service on behalf of a church, organization, or other legal entity, you represent that you have the authority to bind that entity to these Terms.

If you do not agree to these Terms, please do not use the Service.

2. Description of Service

Ekkora is a multi-tenant web application that enables churches to create simple, accessible connection pages for their elderly, homebound, and disabled members. The Service provides a configurable interface allowing church members to access livestreams, contact information, prayer request forms, and other ministry resources with minimal technical knowledge required.

3. Account Registration

Access to the admin portal requires an account created by Ekkora on behalf of your church. You are responsible for:

• Maintaining the confidentiality of your admin login credentials
• All activity that occurs under your account
• Notifying us immediately of any unauthorized access at hello@ekkora.com

End users (church members) do not require accounts to access the member-facing church page.

4. Acceptable Use

You agree not to use the Service to:

• Violate any applicable laws or regulations
• Transmit harmful, offensive, or fraudulent content
• Attempt to gain unauthorized access to our systems
• Interfere with or disrupt the integrity or performance of the Service
• Use the Service for purposes other than legitimate church ministry
• Collect or harvest personal information from other users without consent

5. Content and Data

You retain ownership of all content you upload to the Service, including church logos, URLs, contact information, and configuration data ("Church Content").

You grant Ekkora a limited, non-exclusive license to store, display, and transmit your Church Content solely for the purpose of providing the Service to your church and its members.

You are solely responsible for ensuring your Church Content does not infringe on third-party intellectual property rights or violate applicable laws.

6. Privacy and Prayer Requests

Prayer requests and care requests submitted by church members through the Service are transmitted directly to the email address configured by your church administrator. Ekkora does not store the content of these form submissions on our servers beyond what is necessary for transmission. Please see our Privacy Policy for complete details.

7. Subscription Plans and Billing

Paid plans are billed on a monthly or annual basis as selected at enrollment. Prices are subject to change with 30 days' written notice to your registered email address.

Month-to-month subscriptions may be canceled at any time without penalty, effective at the end of the current billing period. Annual subscriptions are non-refundable but may be canceled before the renewal date to prevent future charges.

Free (Community) plan accounts may be terminated or limited at any time if usage exceeds plan limits or violates these Terms.

8. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted service. Scheduled maintenance, unexpected outages, or force majeure events may cause temporary service interruptions. We will make reasonable efforts to notify you of planned maintenance windows.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, EKKORA SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING UNDER THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE MONTHS PRECEDING THE CLAIM.

11. Termination

Either party may terminate the service relationship at any time. Upon termination, your access to the admin portal and member pages will be deactivated. We will retain your configuration data for 90 days following termination, after which it may be permanently deleted.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Ohio, without regard to its conflict of law provisions.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify registered church administrators of material changes via email. Continued use of the Service after such notification constitutes acceptance of the updated Terms.
